These terms govern your use of BuildCert (buildcert.nz), operated by BuildCert Solutions Ltd trading as BuildCert.NZ ("BuildCert", "we", "us"). By using the service you agree to these terms. If you do not agree, do not use the service.

1. What the service is

BuildCert is an automated information service that compiles a Compliance Information Report from documents you supply. The report is information only and is not certification, approval, or professional advice. See our Disclaimer, which forms part of these terms.

2. Free beta

The service is currently offered free of charge during a testing ("beta") period. It is provided on an "as is" and "as available" basis, may contain errors, and may be changed, suspended, or withdrawn at any time without notice. Any pricing shown on the site is indicative of future paid plans and does not apply during the beta.

3. Your responsibilities

4. Intellectual property

You retain ownership of the documents you upload and the report generated for you. BuildCert retains ownership of the platform, software, and underlying knowledge base. You must not copy or resell the service itself.

5. No warranties

To the extent permitted by law, we give no warranties about the service or any report, including as to accuracy, completeness, or fitness for a particular purpose. Where you use the service in trade, the Consumer Guarantees Act 1993 and the guarantees in the Fair Trading Act 1986 may be contracted out of, and are, to the extent permitted, excluded.

6. Limitation of liability

To the maximum extent permitted by law, BuildCert is not liable for any loss, damage, cost, or delay (including indirect or consequential loss) arising from use of, or reliance on, the service or a report. Nothing in these terms limits rights that cannot lawfully be excluded.

7. Privacy

We handle personal information in accordance with our Privacy Policy.

8. Changes and governing law

We may update these terms from time to time; continued use means you accept the updated terms. These terms are governed by the laws of New Zealand, and the New Zealand courts have jurisdiction.

These terms are a starting draft for your own review. Confirm the operating entity, effective date, and the liability and Consumer Guarantees Act wording before you rely on them.
