Terms of Use

These terms govern your use of BuildCert (buildcert.nz), operated by BuildCert Solutions Ltd trading as BuildCert.NZ ("BuildCert", "we", "us"). By using the service you agree to these terms. If you do not agree, do not use the service.

1. What the service is

BuildCert is an automated information service that compiles a Compliance Information Report from documents you supply. The service is client-led: the report is built from your documents and your evidence, and it identifies the options available to you. It is information only and is not certification, approval, or professional advice. See our Disclaimer, which forms part of these terms.

2. What the service is not

• BuildCert does not recommend whether you should apply for a Certificate of Acceptance, proceed to a determination, or take any legal action.
• BuildCert does not verify the documents or information you provide, and does not gather evidence on your behalf.
• BuildCert does not provide legal, engineering, architectural, surveying, or other professional advice.
• BuildCert does not lodge applications or communicate with any council or authority on your behalf.

3. Free beta

The service is currently offered free of charge during a testing ("beta") period. It is provided on an "as is" and "as available" basis, may contain errors, and may be changed, suspended, or withdrawn at any time without notice. Any pricing shown on the site is indicative of future paid plans and does not apply during the beta.

4. Your responsibilities

• You must have the right to submit the documents you upload.
• You are responsible for the accuracy and completeness of what you provide, and for the content of any report compiled from it.
• You must verify any report before relying on it, and you retain responsibility for all decisions and applications.
• You must not misuse the service, attempt to disrupt it, or use it unlawfully.

5. Intellectual property

You retain ownership of the documents you upload and the report generated for you. BuildCert retains ownership of the platform, software, and underlying knowledge base. You must not copy or resell the service itself.

6. No warranties

To the extent permitted by law, we give no warranties about the service or any report, including as to accuracy, completeness, or fitness for a particular purpose. Where you use the service in trade, the Consumer Guarantees Act 1993 and the guarantees in the Fair Trading Act 1986 may be contracted out of, and are, to the extent permitted, excluded.

7. Limitation of liability

To the maximum extent permitted by law, BuildCert is not liable for any loss, damage, cost, or delay (including indirect or consequential loss) arising from use of, or reliance on, the service or a report. Nothing in these terms limits rights that cannot lawfully be excluded.

8. Privacy

We handle personal information in accordance with our Privacy Policy, including its retention periods.

9. Changes and governing law

We may update these terms from time to time; continued use means you accept the updated terms. These terms are governed by the laws of New Zealand, and the New Zealand courts have jurisdiction.
